1. Validity of the terms of sale

1.1 These terms of sale apply to purchases of goods and services between the buyer of the NURME.EU online store (hereinafter the Consumer) and NURME LOODUSKOSMEETIKA OÜ (hereinafter the online store nurme.eu).

1.2 In addition to these terms, legal relationships arising from the purchase of products from the nurme.eu online store are governed by the Law of Obligations Act of the Republic of Estonia, the Consumer Protection Act, and other legal acts.

1.3 The online store nurme.eu reserves the right to make changes to the terms of sale. These changes are published on the nurme.eu website.

2. Price information

2.1 All prices shown in the nurme.eu online store include 24% VAT.

2.2 The delivery fee is added to the purchase price according to the delivery method selected by the Consumer (DPD parcel locker EUR 3, SmartPost EUR 3, Omniva post office EUR 3).

2.3 Courier delivery costs EUR 6. The online store nurme.eu reserves the right to choose the courier service provider.

2.4 Delivery fees do not apply to orders over EUR 45 that are ordered to a DPD, SmartPost, or Omniva parcel locker.

2.5 If an order was placed before changes were made to the terms of sale or prices, the terms valid at the time the order was placed apply to the legal relationship between the Consumer and nurme.eu.

2.6 The online store nurme.eu reserves the right to change sale prices. These changes are published on the nurme.eu website.

3. Placing an order

3.1 Add the desired products to the shopping cart.

3.2 To place an order, first click the “Add to cart” link in the cart.

3.3 Next, choose whether you want to place the order as a one-time customer or as a loyal customer.

3.4 On the checkout page, fill in the required fields, choose a suitable delivery method, and click “Proceed to payment”. An invoice will then be displayed on the screen, which you can pay conveniently by bank link (Swedbank, SEB, LHV, Coop, Luminor, Mtasku) or by credit card (Visa, Mastercard). Payment details for a euro payment, including all applicable state taxes and additional fees, are shown on the invoice displayed after confirming the order.

The controller of personal data is Nurme Looduskosmeetika OÜ. Nurme Looduskosmeetika transfers the personal data necessary for making payments to authorised processors Maksekeskus AS or Montonio Finance UAB.

3.5 Fill in the fields on the data and order confirmation page carefully, because the speed and smoothness of delivery, as well as later resolution of disputes and complaints, depend on the accuracy and correctness of the information provided.

3.6 Tick the box “I have read and agree to the website terms of sale and privacy policy”.

3.7 Orders placed in the online store are processed on business days from 10:00 to 16:00. If an order is placed on Friday after 12:00, it may be processed on the next business day.

3.8 It takes nurme.eu an average of 1 to 3 business days to dispatch an order, depending on the selected delivery method.

4. Entry into force of the sales contract

4.1 Under the sales contract, the online store nurme.eu undertakes to transfer to the Consumer existing goods, goods to be manufactured, or goods to be acquired by nurme.eu in the future, and to make the transfer of ownership possible. The Consumer undertakes to pay nurme.eu the amount shown on the invoice and to accept the goods.

4.2 Orders that have not been paid for are cancelled 7 days after the order has been placed.

4.3 The sales contract enters into force after the payment made by the Consumer has been received in the online store’s bank account.

5. Delivery

5.1 After the sales contract enters into force, the online store nurme.eu prepares the order and hands it over to the company’s logistics partners for delivery. An order that has already been placed can no longer be cancelled.

5.2 Delivery times shown on the nurme.eu website apply from the moment the order amount is received in the online store’s bank account. The average delivery time is 1 to 3 business days.

5.3 To ensure prompt delivery, please be careful and provide accurate and valid delivery details when placing the order. If the goods have not reached the Customer within a reasonable time, please contact us by email at [email protected] so that we can check the recipient details. For orders that do not reach the addressee and are returned to nurme.eu by the logistics partner, the Customer will be refunded within 7 business days from the day the returned order is delivered back to nurme.eu.

5.4 The online store nurme.eu is not responsible for delivery delays if the goods were handed over to the logistics partners on time but the delay was caused by circumstances that the online store nurme.eu could not influence or foresee.

6. Right of return

6.1 After receiving the order, the Consumer has the right to withdraw from the contract concluded in the online store within 14 days without giving a reason. To return goods, please first submit a return request. In the message, please include the order number, customer details, and the product you wish to return.

6.2 Returned goods must be undamaged, unused, and in the original packaging.

6.3 Goods can be returned by sending them through the same parcel locker from which the parcel was collected. When returning a parcel from an Omniva or Smartpost parcel locker, you can use the same door code that was used to collect the parcel. For returns by DPD, please contact us at [email protected] so that we can prepare a parcel label for you. The cost of returning the goods is paid by the buyer. If the buyer uses the return code included in the notification, the shipping cost will be deducted from the refundable amount according to the nurme.eu price list.

6.4 If your purchase included a gift (for example, you received a gift when purchasing products for a certain amount or with the purchase of a specific product), the gift must also be returned undamaged, unused, and unopened. If the gift is not returned together with the rest of the goods, the value of the gift will be deducted from the refundable amount.

6.5 If you received the wrong goods or if the goods were damaged during transport, please contact [email protected].

6.6 Upon receiving the returned goods, the online store nurme.eu will refund the buyer without delay, but no later than 14 days from receiving the withdrawal statement, all payments received from the buyer under the contract. The online store may refuse to make refunds until it has received the returned item or until the buyer has provided proof that the item has been sent back, whichever occurs first.

6.7 To use the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, characteristics, and functioning of the goods in the same way as would be permitted for testing goods in a physical store.

6.8 The 14-day right of return does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons and have been opened after delivery (lip balms, creams, soaps, body lotions, deodorants, body butters, essential oils, body oils, body scrubs, shampoos, conditioners, shower gels).

7. Force majeure

7.1 The online store nurme.eu is not responsible for damage caused to the Customer or for delivery delays if the damage or delay was caused by circumstances that the online store nurme.eu could not influence or foresee.

8. Processing of personal data

8.1 The online store nurme.eu is the controller of personal data. The online store nurme.eu transfers the personal data necessary for making payments to the authorised processor Maksekeskus AS.

8.2 By entering data in the online store and giving the relevant confirmation, the Consumer grants the right to collect and process the Consumer’s personal data (name, contact phone number, parcel delivery and/or home address, email address) and to transfer personal data to the logistics partner for delivery of the goods.

8.3 The online store nurme.eu has the right to use the Consumer’s residence or location address to send advertising and other information to the Consumer.

8.4 The Consumer has the right at any time to prohibit the collection and use of their personal data, except where this is necessary to collect a claim arising from the contract or to deliver the goods.

8.5 Electronic personal data is used for direct marketing only if the Consumer has given separate consent for this.

8.6 Encrypted data communication with banks when paying for purchases ensures the security of the Consumer’s personal bank credentials, and the online store has no access to them.

9. Consumer’s right to contact the Consumer Protection and Technical Regulatory Authority

9.1 If the online store has refused to resolve the Consumer’s complaint, or if the Consumer does not agree with the solution offered by the online store and believes that their rights have been violated or their interests harmed, the Consumer may file a complaint with the Consumer Disputes Committee through the Consumer Protection and Technical Regulatory Authority or with a court. The Consumer may file the complaint personally or through a representative. Details of the Consumer Protection and Technical Regulatory Authority are available on their website. For problems arising in European Union member states, the Consumer may contact the European Union Consumer Advice Centre or submit an application through the European Union online dispute resolution platform.

10. Right to submit a complaint

10.1 The online store nurme.eu is responsible for any non-conformity or defect of goods sold to the buyer that existed at the time of delivery and that becomes apparent within two years from delivery of the goods to the buyer. During the first year from delivery of the goods to the buyer, it is presumed that the defect already existed at the time of delivery. Rebutting this presumption is the responsibility of the online store.

If a defect appears, the buyer has the right to contact the online store no later than within two months by sending an email to [email protected] or by calling +372 56662588.

10.2 The online store is not responsible for defects that occur after the goods have been delivered to the buyer. If goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store will refund the buyer all fees related to the sales contract. The online store responds to the Consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.
